Terms of Service

1. The service

BeyondClaim is a severe weather intelligence platform operated by Kodeway Inc. The service queries NEXRAD radar, NWS storm reports, USGS stream gauges, and NHC hurricane track data to produce weather event histories for Texas property addresses. Results are used to support insurance claim documentation and property due diligence.

BeyondClaim is currently in public beta (v0.9) and available for Texas addresses only. Coverage is expanding to Oklahoma, Louisiana, and Florida in Q3 2026.

2. Your account

You must be 18 or older and authorized to act on behalf of the company you register. You are responsible for keeping your credentials secure and for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the free-lookup tier.

3. Plans, pricing, and the free tier

Every new account receives 5 free lookups with no credit card required:

Founding-member pricing is locked for life on the plan you choose at signup. Prices may increase for new subscribers after the beta period.

4. Billing and cancellation

Subscription plans are billed monthly. Payments are processed by Stripe; by subscribing you agree to Stripe’s terms of service. You may cancel at any time from account settings — your access continues through the end of the current billing period.

No refunds. The 5 free lookups on signup are your risk-free trial — they let you verify the product works before paying anything. We do not offer refunds on paid lookups or subscription charges.

6. Data accuracy and limitations

BeyondClaim results are derived from publicly available government radar and weather data (NEXRAD, NWS, USGS, NHC). We apply calibration and cross-referencing to maximize accuracy, but weather data is inherently probabilistic.

BeyondClaim reports are evidence for your review, not a guarantee of insurance claim outcomes. Final claim decisions rest with the insurer. We are not responsible for decisions made based on our data.

Coverage is limited to Texas addresses and events from May 2021 onward. Events before that date are outside our data window and will not appear in results.

7. Intellectual property

The BeyondClaim platform, software, brand, and original content are owned by Kodeway Inc. The underlying weather data (NEXRAD, NWS, USGS, NHC) is U.S. government data in the public domain.

PDF reports generated from your lookups are yours to use for legitimate claim and property work. You may not present them as independently verified certifications or misrepresent their source.

8. Limitation of liability

To the maximum extent permitted by law, Kodeway Inc’s liability for any claim arising from your use of BeyondClaim is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits or claim denials, even if advised of the possibility of such damages.

9. Governing law

These terms are governed by the laws of the State of Texas. Any dispute arising from your use of BeyondClaim shall be resolved in the courts of Travis County, Texas, and you consent to personal jurisdiction there.

10. Changes to these terms

We may update these terms as the product evolves. Material changes will be communicated via email at least 14 days before taking effect. Continued use after that date constitutes acceptance.
